The provider and owner of ActiveEMR.

3. Services

The application provides the following capabilities:

• Appointment Scheduling: Booking and management of patient appointments with reminders.
• Consultation Management: Tools for managing consultation sessions and storing consultation notes.
• Prescription Generation: Create prescriptions within the application.
• Medicine Template Management: Create and reuse medicine templates for efficient prescription workflows.
• Patient Medical History Access: Secure access to patient medical history and past consultations.
• Electronic Medical Records (EMR) Management: Manage patient records and related clinical information in a secure system.
• Secure Patient Information Storage: Protected storage for patient information accessible only to authorized users.

4. Responsibilities

Users agree to:

• Maintain strict confidentiality of login credentials and access tokens.
• Use the application only for authorized healthcare purposes within the scope of their roles.
• Comply with applicable laws and regulations governing their use of the application.
• Report any unauthorized access or security breaches promptly to Aether Enterprise Applications LLP.
• Ensure all patient information entered is accurate, complete, and up-to-date.
• Not share patient data with unauthorized third parties.
• Not attempt to reverse-engineer, hack, or exploit the system.
• Notify Aether Enterprise Applications LLP of changes in organizational information or user authorization status.

5. Privacy & Security

Aether Enterprise Applications LLP treats patient information as confidential and implements reasonable security measures to protect it. Access is restricted to authorized users, and users are responsible for safeguarding their credentials and handling healthcare information in accordance with applicable laws and regulations.

• Confidentiality: Patient information is treated as confidential and is accessible only to authorized users.
• Secure Access: Role-based access controls are used to limit access to relevant patient data.
• Credential Protection: Users are responsible for protecting their login credentials and access tokens.
• User Responsibility: Users must handle patient information in accordance with applicable laws and professional obligations.

6. Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Aether Enterprise Applications LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the application.
• The total liability of Aether Enterprise Applications LLP is limited to direct damages to the extent permitted by applicable law.
• The application is provided "as is" without warranties of any kind, either express or implied.
• Aether Enterprise Applications LLP does not guarantee uninterrupted or error-free operation of the Services.

7. Termination

Aether Enterprise Applications LLP reserves the right to suspend or terminate your access if:

• You violate any provision of these Terms & Conditions.

• You use the application for purposes outside authorized healthcare operations.
• You fail to comply with applicable laws and regulations.
• Your professional credentials are revoked or suspended by regulatory authorities.

Upon termination, access to the Services will cease. Any handling of patient data after termination will be governed by applicable law and any data processing agreement between you and Aether Enterprise Applications LLP.

8. Governing Law

These Terms & Conditions are governed by the laws of India.

Jurisdiction: You agree that any legal proceedings shall be brought exclusively in the courts of Pune, Maharashtra, and you consent to the jurisdiction of such courts.
